HOUSTON - A lawsuit is claiming a man was dragged in a Kroger parking lot after partially entering a “getaway” vehicle to retrieve his stolen bag.
Seeking up to $1 million in damages, Jaffer Abbas filed suit against Kroger Texas, Metro One Loss Prevention Services and John Doe on July 1 in Harris County District Court.
According to the lawsuit, on Jan. 28 Abbas had just finished shopping at a Houston Kroger and was getting into his vehicle when Doe opened up the rear door and stole his messenger bag. Doe then ran toward a nearby waiting vehicle.
“Plaintiff instinctively chased after the suspect and partially entered the vehicle in an attempt to retrieve his belongings,” the suit states. “While trying to recover the bag, Plaintiff was physically assaulted and dragged as the getaway vehicle sped off.”
The suit is alleging gross negligence and seeks damages for the plaintiff’s pain, medical costs, impairment and disfigurement.
