U.S. Attorney Michael DiGiacomo announced the arrest of Jose Guadalupe Mauricio-Rivera, a 33-year-old Mexican citizen, on charges of illegal re-entry into the United States. The criminal complaint against him includes potential penalties of up to two years in prison and a $250,000 fine.
Assistant U.S. Attorney Colleen M. McCarthy is handling the case. According to her statement, Immigration and Customs Enforcement Office of Enforcement and Removal Operations (ICE-ERO) identified Mauricio-Rivera as being unlawfully present in the country on April 13, 2025. He was found outside a residence in Warsaw, NY, where records confirmed his illegal status in the U.S. He had been deported from the United States previously in July 2012 and April 2018.
The arrest falls under Operation Take Back America, an initiative by the Department of Justice aimed at curbing illegal immigration and dismantling cartels and transnational criminal organizations.
Mauricio-Rivera appeared before U.S. Magistrate Judge H. Kenneth Schroeder Jr., who ordered his detention.
The investigation leading to this complaint was conducted by ICE-ERO under Acting Field Office Director Steven Kurzdorfer's supervision.
It is important to note that charges are accusations only; Mauricio-Rivera is presumed innocent until proven guilty.
