Honduran national sentenced for illegal U.S. reentry and pending DUI charge

A man from Honduras has been sentenced in federal court for illegal reentry into the United States, as announced by Acting United States Attorney Troy Rivetti. The sentence was handed down by Senior United States District Judge Nora Barry Fischer in Pittsburgh, Pennsylvania, on April 29, 2025.

Luis Fernando Diaz-Garcia, aged 27, was arrested by Pennsylvania State Police and faced charges for driving under the influence and other traffic violations, such as driving without a license, following an incident where he allegedly nearly collided with a marked police vehicle. These charges are still pending. Upon his arrest on January 27, 2025, immigration officials confirmed that Diaz-Garcia was illegally in the U.S. He had previously been deported on November 13, 2019, and reentered without obtaining the necessary permission. Diaz-Garcia has been in federal custody since his arrest for illegal reentry and will be transferred to immigration authorities.

The case was prosecuted by Assistant United States Attorney Rebecca L. Silinski on behalf of the government. Acting U.S. Attorney Rivetti praised the efforts of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in investigating the case, which led to the successful prosecution.

The case is part of Operation Take Back America, an initiative led by the Department of Justice to eliminate cartels and transnational criminal organizations, address illegal immigration, and protect communities from violent crime.
