James Tetreault Pleads Guilty to Notarial Misconduct

 Attorney General John M. Formella announces that James Tetreault (age 60) of Winchester, New Hampshire has pled guilty and been sentenced in Keene District Court to one class A misdemeanor count of Notarial Misconduct. 

Mr. Tetreault, a New Hampshire justice of the peace, signed a marriage license stating that he had performed a marriage between Wendy Leedberg-Snow and Eric Leedberg on September 14, 2023.  Mr. Tetreault fully cooperated with the State’s investigation and admitted that he did not officiate or attend a marriage between Ms. Leedberg-Snow and Mr. Leedberg on September 14, 2023, or any other date.

The State charged Mr. Tetreault with one class B felony count of Vital Records Fraud, contrary to RSA 5-C:14 & RSA 5-C:49, and one class A misdemeanor count of Notarial Misconduct, contrary to RSA 455:16, I(b) & RSA 455:16, II. 

As part of a negotiated plea, Mr. Tetreault pled guilty to the notarial misconduct charge, and the State nolle prossed the vital records fraud charge.  The Court sentenced Mr. Tetreault to 90 days in the house of corrections, all suspended for a period of two years on the condition of good behavior.  Mr. Tetreault was further ordered to pay a $1,000 fine with a $240 penalty assessment.  Mr. Tetreault also resigned his justice of the peace commission and his bail commissioner position, and he agreed not to seek to be recommissioned as a justice of the peace or notary public during the two-year suspension period.

This case was prosecuted by Assistant Attorneys General Matthew Conley and Brendan O’Donnell of the Election Law Unit. The investigation into this matter was conducted by New Hampshire Department of Justice Investigator Jennifer DiGeorge.
