DOJ announces indictment for suspended Wilmington Police Officer in use of force case

On April 14, suspended Wilmington Police Officer Sgt. Caro Spearman was indicted on charges of Assault Third Degree, Offensive Touching and two counts of Official Misconduct in New Castle County Superior Court. The indictment follows an investigation led by the Wilmington Police Department in connection with the Delaware Department of Justice’s Division of Civil Rights and Public Trust.

“The evidence in this case is alarming” said Attorney General Kathy Jennings. “The overwhelming majority of police officers in this State are a credit to their name and their communities—but when a sworn officer breaks the law it is imperative to hold them accountable. I am deeply grateful to our prosecutors for this important work, and to the Wilmington Police Department for their timely and thorough cooperation with this investigation.”

“The allegations in this case are very concerning, and reflect behavior that I believe falls far short of the high expectations we set for our public servants,” said Wilmington Police Chief Wilfredo Campos. “We immediately brought this incident to the attention of the Division of Civil Rights and Public Trust, and have been assisting them in their investigation.”

On April 9, 2024, WPD officers responded to a complaint of a disorderly subject at the Big Fish Grill and the Hyatt Hotel on Justison Street in Wilmington. During the course of the arrest, the victim spat on several officers. After handcuffing her, Sgt Spearman grasped the victim by the elbow and slung her to the ground; the victim subsequently spat on Sgt. Spearman. Sgt. Spearman responded by slapping the victim in the face, knocking her upper body and head to the ground. The victim was taken to the Wilmington Hospital where she was treated and released that same night.
