A Guatemalan national, Jose Garcia, has been indicted in Boston for allegedly reentering the United States unlawfully after being deported. The 39-year-old was charged with one count of unlawful reentry of a deported alien. His arrest and charge followed a criminal complaint in March 2025, leading to his release under specific conditions.
Court documents indicate that Garcia was originally deported from the U.S. on January 5, 2006. Allegations suggest he reentered the country illegally after his removal. U.S. Immigration and Customs Enforcement became aware of Garcia's presence following arrests on July 30, 2022, September 8, 2023, and January 29, 2024.
If convicted, the charge of unlawful reentry could result in a sentence of up to two years in prison, one year of supervised release, and a fine amounting to $250,000. Sentencing is determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.
The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director in Boston for U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations. The case is being prosecuted by Assistant U.S. Attorney Brian J. Sullivan of the Narcotics and Money Laundering Unit.
