California Attorney General Rob Bonta leads a coalition of 22 attorneys general in opposing a proposed rule by the U.S. Department of Health and Human Services (HHS). The comment letter contends that amendments to rules governing health insurance marketplaces could undermine the Affordable Care Act (ACA)'s mission. The changes might lead to millions losing coverage and increased insurance costs.

Attorney General Bonta emphasized, "No one should ever have to go without the care they need due to cost or other barriers surrounding health insurance." He reiterated the commitment to ensuring California residents have access to quality, affordable healthcare.

California ranks third in ACA plan enrollees. Proposed changes include a shortened enrollment period, and ending coverage for millions, including Deferred Action for Childhood Arrivals (DACA) recipients. The measure challenges the inclusion of gender-affirming care as an Essential Health Benefit, potentially shifting cost burdens to states.

The letter highlights the proposal's impacts: reduced enrollment access due to a shorter period, potential premium increases, and additional barriers to coverage. It also challenges the exclusion of DACA recipients from exchanges, potentially affecting uninsured rates and public health. The exclusion of gender-affirming care as an Essential Health Benefit is noted as a potential violation of the Equal Protection Clause and ACA.

Attorney General Bonta remains committed to protecting healthcare access, evidenced by recent legal actions defending healthcare rights for DACA recipients and opposing Executive Orders targeting transgender individuals' healthcare.

Joining Bonta are attorneys general from New Jersey, Massachusetts, among others, who have also endorsed the comment letter.
