Three Snohomish County men are in federal detention following their indictment for conspiracy, drug trafficking, and gun crimes. Percy Levy, Eugene Smith, and Robert O. Baggett are being held at the Federal Detention Center at SeaTac. A hearing today presided over by Magistrate Judge Michelle Peterson resulted in Baggett remaining in custody pending trial. Levy and Smith have separate detention hearings scheduled later this week and next. Their jury trial is set for June 9, 2025, before Judge John H. Chun.
According to court records, Levy and Baggett were under observation by the Snohomish Regional Drug Task Force as early as 2023 for cocaine trafficking. Baggett allegedly sold cocaine, fentanyl, and methamphetamine to an undercover officer and named Percy Levy as his superior in the operation. Surveillance later identified Smith as an additional conspirator. On March 13, 2025, Smith was apprehended after delivering cocaine and fentanyl to an undercover officer at a casino.
Officers executed a search warrant on Levy's residence following Smith's arrest. They discovered cocaine, fentanyl powder, digital scales, packaging materials, and a loaded firearm underneath a pillow in the room where the drugs were found.
Baggett is accused of selling both drugs and firearms during transactions with undercover officers.
All three defendants have extensive criminal records, preventing them from legally possessing firearms. Levy's criminal history includes convictions for burglary, assault with a deadly weapon, and robbery, dating back to 1988. Baggett's record dates back to 1983, with 14 felony convictions, including theft and assault. Smith's criminal history stretches back to 1976, with convictions for robbery, drug trafficking, and assault. He was sentenced to life in prison in 1996 under the state's Third Strike law, but his sentence was conditionally commuted in 2020.
The men face charges of conspiracy to distribute controlled substances. Levy faces additional charges for possession with intent to distribute cocaine and fentanyl, and possession of a firearm in furtherance of drug trafficking. Levy and Baggett also face charges for unlawful firearm possession.
Levy’s charges carry a mandatory sentence of 15 years to life in prison, while Baggett and Smith face mandatory sentences of ten years to life in prison.
Under the law, the charges remain allegations until proven in court.
The investigation is being conducted by the Snohomish Regional Drug Task Force and the FBI. The case is being prosecuted by Assistant United States Attorneys Brian Wynne and Cindy Chang.
