The owners and operators of a Warwick pain management clinic have been indicted by a federal grand jury for alleged involvement in healthcare fraud. Acting United States Attorney Sara Miron Bloom announced the charges against Brandon Nowak, 32, and Jason Simmons, 33, both from Foster, Rhode Island. They are officers and operators of Alternative Integrative Medicine, LLC, operating as Aim Health.
Nowak and Simmons face charges for conspiracy to commit healthcare fraud and fourteen counts of healthcare fraud. The allegations state that from October 2020 onwards, they conspired to submit fraudulent claims to government and private insurers, including Medicare, Medicare Advantage, and Medicaid Managed Care. These claims were purportedly for "medically necessary" services that were not provided to patients.
Further accusations claim that Nowak and Simmons misrepresented massage therapy as a covered insurance service. They allegedly billed insurers for services such as acupuncture and physical therapy, which were not provided. Other alleged fraudulent claims included services like infrared therapy and therapeutic activity, for which appropriate providers were reportedly not employed by Aim Health.
The defendants are scheduled for arraignment in U.S. District Court on April 11, 2025. It is noted that a federal indictment is merely an accusation, and the defendants are presumed innocent until proven guilty.
Assistant United States Attorney Dulce Donovan is prosecuting the case, with support from Assistant United States Attorney John P. McAdams. The investigation involved the U.S. Health and Human Services, the Federal Bureau of Investigations, the Department of Defense Criminal Investigative Service, and the U.S. Department of Veterans Affairs.
