Austin Gage Osborn, 24, and Jose Adrian Hermosillo, 22, both from Oklahoma City, were sentenced to federal prison for illegal firearms dealing. Osborn will serve 68 months for operating a firearms business without a license and for being a drug user in possession of firearms, as announced by U.S. Attorney Robert J. Troester.
From July 2024, undercover agents from the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) engaged Osborn and Hermosillo in transactions to purchase approximately 20 firearms. Hermosillo, a convicted felon barred from possessing firearms, participated in these dealings.
One transaction on July 29, 2024, involved undercover agents informing Osborn and Hermosillo that the purchased firearms would cross into Mexico. Despite this, Osborn and Hermosillo continued selling guns without a federal license, which violates federal laws.
Osborn faced charges on November 26, 2024, for dealing firearms without a license and for possession during drug use. He pled guilty and owned up to possessing 19 firearms while regularly using marijuana. On March 26, 2025, U.S. District Judge Scott L. Palk sentenced Osborn to over five and a half years in federal prison, with three years of supervised release thereafter.
Hermosillo pled guilty on November 26, 2024, to firearms trafficking, acknowledging he transferred weapons which he reasonably believed might be used feloniously. Hermosillo received a 168-month federal prison sentence on March 24, 2025, followed by a three-year supervised release.
Judge Palk emphasized the offenses' severity and the sentences' deterrent effect. He considered the defendants' backgrounds, including Hermosillo's previous felony convictions in Oklahoma County for attempted burglary and firearm possession after juvenile adjudication.
The ATF and Oklahoma City Police Department investigated this case, prosecuted by Assistant U.S. Attorneys Drew E. Davis and Mary E. Walters.
