A Dominican national, Jose De La Rosa Rosario, has been sentenced in a federal court in Boston for reentering the United States illegally after being deported. Chief Judge F. Dennis Saylor IV sentenced De La Rosa Rosario, 50, to 15 months in prison followed by one year of supervised release. Deportation will follow the completion of his prison term.
De La Rosa Rosario had pleaded guilty in December 2024 to the charge of unlawful reentry of a deported alien, after being indicted by a federal grand jury in October 2024. Originally entering the United States in 2006 through Puerto Rico with false identification, De La Rosa Rosario was later convicted on federal conspiracy and cocaine distribution charges in 2011. After serving his sentence, he was deported in July 2018 based on a court order.
Despite this, De La Rosa Rosario managed to return to the U.S. illegally and was arrested in September 2024 on new state drug charges. He was subsequently detained by U.S. Immigration and Customs Enforcement. An examination of the fingerprints from his removal document confirmed his identity as they matched those taken upon his federal custody entry in September 2024.
U.S. Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston, jointly announced the sentencing. The case was prosecuted by Special Assistant U.S. Attorney James J. Nagelberg of the Major Crimes Unit.
