Tennessee AG urges consumer action on $39.1 million generic drug price settlement

Tennessee Attorney General Skrmetti, together with a bipartisan coalition of attorneys general from various states and territories, is urging consumers to check if they are eligible for compensation related to certain generic drug purchases. This appeal follows an effort towards obtaining preliminary approval for a $39.1 million settlement with the generic drug manufacturer Apotex. The settlement addresses allegations of a conspiracy to raise drug prices and reduce market competition.

Previously, Attorney General Skrmetti and the coalition had announced a tentative agreement with Apotex last year. It was alongside a $10 million settlement with Heritage Pharmaceuticals. This agreement was contingent on receiving signatures from all relevant states and territories, which has now been achieved. Consequently, the coalition is proceeding to file the settlement in the U.S. District Court for the District of Connecticut.

The settlements aim to resolve accusations that both Apotex and Heritage Pharmaceuticals engaged in prolonged conspiracies to artificially inflate and manage prices while limiting competition and unreasonably restraining trade concerning numerous generic prescription drugs. As part of the settlements, both companies have agreed to cooperate with ongoing multistate litigations involving 30 corporate defendants and 25 individual executives. Additionally, they have committed to a series of internal reforms to promote fair competition and ensure antitrust law compliance.

In addition to Tennessee, attorneys general from multiple states and territories, including Alaska, Arizona, California, Colorado, Connecticut, and others, have joined in announcing this settlement.
