Omaha women receive probation for wrongful disclosure of health information

Acting United States Attorney Matthew R. Molsen has announced the sentencing of Oliva Gross, 47, from Omaha, Nebraska. She was sentenced on March 14, 2025, in federal court for the wrongful disclosure of health information. Chief United States District Court Judge Robert F. Rossiter, Jr. sentenced her to two years of probation.

Earlier, on March 7, co-defendant Kiara Gross, 24, also from Omaha, received a similar sentence of two years' probation for the same offense. It is important to note that there is no parole in the federal system.

The incident took place at Mid-City OB-GYN in Omaha where both individuals were employed as medical assistants. The facility provides obstetrics and gynecology services among others and falls under the regulations of the Health Insurance Portability and Accountability Act (HIPAA). HIPAA restricts access to and disclosure of a patient's identifiable health information without authorization.

Kiara Gross worked at Mid-City OB-GYN from May 2019 until December 13, 2023. Olivia Gross had been with the organization since July 2009 until December 2023. The unauthorized access occurred on December 11, 2023, when they obtained health care information related to Victim 1 without consent.

The Federal Bureau of Investigation conducted the investigation into this case.
