America First Legal Vice President Dan Epstein testified before the House Judiciary Committee’s Constitution and Limited Government Subcommittee on legislative reforms to address lawfare by state and local prosecutors. In his testimony, Epstein criticized the Biden-Harris Administration for allegedly using the rule of law against political opponents.

Epstein stated, "President Donald J. Trump overcame the most vindictive weaponization of the justice system against an American leader in our Nation’s history." He referenced various legal challenges faced by Trump, including two impeachment attempts and multiple criminal indictments.

Epstein argued that New York State lacked jurisdiction over campaign charges against Trump, claiming District Attorney Alvin Bragg violated a Supreme Court doctrine known as the “primary jurisdiction doctrine.” According to Epstein, this doctrine suggests that issues within federal election law fall under the exclusive purview of federal agencies like the Federal Election Commission (FEC) and Department of Justice (DOJ).

"The relevant sections of FECA clearly articulate this exclusive jurisdiction," said FEC Commissioner Trainor in previous testimony. Epstein claimed that despite these regulations, Bragg pursued charges based on allegations previously dismissed by federal authorities.

Epstein also alleged coordination between Bragg's office and Biden's DOJ, highlighting contributions from senior Biden operatives to Bragg's campaign. He mentioned Matthew B. Colangelo's involvement with both Biden’s DOJ and Bragg’s office as indicative of coordinated efforts against Trump.

The hearing underscored ongoing debates about state versus federal jurisdiction in prosecuting high-profile figures and raised questions about potential political motivations behind legal actions involving former President Trump.
