Christopher Fitzgerald Spivey, Jr., a 40-year-old resident of Melbourne, has pleaded guilty to four counts of distributing controlled substances. The announcement was made by Acting United States Attorney Sara C. Sweeney. Due to Spivey's previous conviction for a serious violent felony, he faces a minimum sentence of 15 years and could receive up to life in federal prison. A sentencing date is yet to be determined.
Court documents reveal that between November 5 and December 10, 2024, Spivey distributed fentanyl and methamphetamine on four separate occasions to a confidential source. The total amount involved includes over 55 grams of fentanyl and nearly 1,300 grams of pure methamphetamine. Before these offenses, Spivey had been convicted for aggravated assault upon a law enforcement officer, which resulted in a 10-year sentence.
The United States government also plans to seize $10,500 from Spivey as it represents the proceeds from his criminal activities.
The investigation into this case was conducted by the Drug Enforcement Administration and the Federal Bureau of Investigation. Assistant United States Attorney Megan Testerman is leading the prosecution.
