An undocumented immigrant residing in St. Charles County, Missouri, has been indicted by a U.S. District Court in St. Louis on charges related to child pornography. Francisco J. Ocana-Talamantes, 46, faces one count of receiving child pornography after allegedly obtaining images containing child sexual abuse material via the internet between February 11, 2020, and March 14, 2024.
Ocana-Talamantes is currently in custody. The indictment serves as an accusation and does not imply guilt; all defendants are presumed innocent until proven otherwise.
A motion has been filed to keep Ocana-Talamantes detained until his trial due to his illegal status in the United States. "The FBI and our local law enforcement partners had been investigating Franscisco Ocana-Talamantes for his alleged crimes against children," stated Special Agent in Charge Ashley Johnson of the FBI St. Louis Division. She added that Ocana-Talamantes' illegal entry into the country allowed for expedited federal indictment and arrest through collaboration with the U.S. Department of Homeland Security's immigration enforcement action.
If convicted, Ocana-Talamantes could face a minimum of five years in prison, with a maximum sentence of up to 20 years.
The investigation was conducted by the FBI alongside the St. Charles Police Department and the St. Charles County Cyber Crime Task Force. Assistant U.S. Attorney Jillian Anderson is prosecuting the case.
This case is part of Project Safe Childhood, an initiative launched by the Department of Justice in May 2006 aimed at combating child sexual exploitation and abuse nationwide. This program unites federal, state, and local resources to locate and prosecute offenders while rescuing victims from online exploitation.
