Coalition challenges executive order banning transgender military service

Attorney General Dan Rayfield of Oregon has joined a coalition of 20 attorneys general in filing an amicus brief to support a lawsuit challenging President Trump's executive order that bans transgender individuals from serving in the military. The brief, filed today, argues that the order is unconstitutional and discriminatory, harming national security and excluding capable service members.

"This is a blatant attack on the rights and dignity of our service members," said Rayfield. "Oregonians believe in fairness, inclusion, and respect for all people, regardless of gender identity. This order not only undermines the people who put their lives on the line for our country, but it also weakens our military by excluding qualified and dedicated individuals."

The coalition claims that the ban could negatively impact state emergency preparedness and violate state laws protecting transgender rights. Additionally, they argue that it breaches the 5th Amendment's equal protection clause by discriminating based on gender identity.

Transgender individuals have been part of the military for years. A study conducted in 2014 indicated around 150,000 veterans and active servicemembers identified as transgender. Military reviews have concluded that allowing these individuals to serve according to their gender identity benefits national interests.

The amicus brief backs a preliminary injunction request from current and prospective transgender service members involved in a lawsuit at the United States District Court for the District of Columbia. A hearing is scheduled for February 18, 2025.

States joining Oregon include California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, North Carolina, Rhode Island, Vermont, Washington State and Wisconsin.
