Attorney General Charity Clark has announced a settlement with Hearing At Home, LLC, in relation to alleged violations of Vermont’s Consumer Protection Act. The act prohibits unfair methods in commerce and deceptive acts concerning the sale of over-the-counter hearing aids.
Hearing At Home, LLC operates under the brand Nano Hearing Aids and is the successor to Nano Hearing Tech Opco, LLC. In January 2023, the Attorney General's Office filed a lawsuit against Nano Hearing Aids. The lawsuit claimed that the company engaged in misleading advertisements, misrepresented product design and effectiveness, offered a deceptive online hearing test, sold products under perpetual sales terms, marketed hearing aids to consumers under 18 years old, and failed to disclose promotions that void return policies.
Under new ownership, Hearing At Home addressed many of these concerns and reached a settlement for its part in the lawsuit. According to this agreement:
Due to financial constraints and cooperation during the investigation by Hearing At Home, the establishment of a restitution fund and payment of civil penalties have been postponed until the company can afford them.
This settlement does not resolve all aspects of the case. The State will continue its enforcement action against previous owners of Nano Hearing Aids for their violations of consumer protection laws.
