A Henryetta resident, Cody Lynn Lusk, has pleaded guilty to charges of burglary and assault in Indian Country. The United States Attorney’s Office for the Eastern District of Oklahoma announced that Lusk, aged 34, admitted guilt to one count of Burglary in the First Degree and one count of Assault of a Spouse, Intimate Partner, or Dating Partner by Strangling, Suffocating, and Attempting to Strangle and Suffocate.
According to the indictment, on March 22, 2024, Lusk unlawfully entered a dwelling with the intent to commit a crime. It further alleged that he strangled and suffocated a dating partner. These incidents took place in Muskogee County within the Cherokee Nation Reservation's boundaries.
The case was investigated by the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department. The plea was accepted by U.S. Magistrate Judge D. Edward Snow at the United States District Court for the Eastern District of Oklahoma. A presentence investigation report has been ordered following this plea.
Lusk is currently held by the United States Marshals Service as he awaits sentencing. The prosecution was led by Assistant U.S. Attorneys Caila M. Cleary and Morgan Muzljakovich.
