A Mexican citizen has been indicted by a federal grand jury for illegal reentry into the United States after a prior removal, as announced by U.S. Attorney Nicholas J. Ganjei.
Hector Salvador Lozano-Davila, 33, is currently in custody and will soon appear for his arraignment before a U.S. magistrate judge.
The criminal complaint states that on January 11, authorities encountered Lozano-Davila near Roma. It is alleged that he entered the United States from Mexico on the same day. A records check revealed that Lozano-Davila had been previously convicted of sexual assault of a child in 2019 and was subsequently removed to Mexico in November 2021.
If found guilty, Lozano-Davila could face up to 20 years in federal prison and a possible fine of up to $250,000.
The investigation was conducted by Border Patrol, with Assistant U.S. Attorney Laura Garcia prosecuting the case.
It is important to note that an indictment is merely an accusation of criminal conduct and not evidence. The defendant remains presumed innocent unless proven guilty through due process of law.
