A federal grand jury in Greenville has indicted Sergio Ixtepan-Toto, a 36-year-old Mexican national, for unlawful entry into the United States. Ixtepan has been deported three times prior to this incident.

Court documents reveal that officers from the Pickens Police Department arrested Ixtepan on December 6, 2024, on charges of driving under the influence. A review of his immigration file showed deportations in May 2020, November 2022, and February 2024. Re-entry into the U.S. would require permission from the Attorney General, which records indicate Ixtepan did not obtain. Additionally, he faces charges of driving under the influence and domestic violence on multiple occasions.

Ixtepan was arraigned before United States Magistrate Judge Kevin McDonald.

The investigation was conducted by U.S. Immigration and Customs Enforcement, the Department of Homeland Security, and the Pickens Police Department. Assistant U.S. Attorney Max B. Cauthen is handling the prosecution.

All charges are accusations at this stage, with defendants presumed innocent until proven guilty beyond a reasonable doubt in court.
