Attorney General John M. Formella announces that Tabitha Maguire, age 49, has been convicted and sentenced on a class A felony charge of Theft by Deception. The Merrimack County Superior Court sentenced Ms. Maguire for stealing $8,667.00 by submitting fraudulent mileage reimbursement request forms for non-emergency medical transportation as part of New Hampshire Medicaid’s Family and Friends Mileage Reimbursement Program. Ms. Maguire deceptively obtained the reimbursement payments by claiming that she resided in Wakefield, New Hampshire and was traveling almost daily to a medical facility in Somersworth, when in fact Ms. Maguire resided in Somersworth, within two miles of the facility.
The Court sentenced Ms. Maguire to serve 12 months at the Merrimack County House of Corrections with all but eight consecutive weekends of the sentence suspended for a period of five years. The remainder of the sentence is suspended on the condition that Ms. Maguire remain of good behavior and not participate in the Family and Friends Mileage Reimbursement Program. Additionally, the Court ordered Ms. Maguire to pay restitution of $8,667.00 to the New Hampshire Department of Health and Human Services.
Financial Investigator Timothy Brackett of the New Hampshire Department of Justice’s Medicaid Fraud Control Unit and Eric Shirley, formerly an investigator with the Medicaid Fraud Control Unit, investigated this matter with assistance from the Wakefield Police Department. The case was prosecuted by Senior Assistant Attorney General Thomas Worboys and Assistant Attorney General Andrew Yourell, both of the Medicaid Fraud Control Unit.

The Medicaid Fraud Control Unit receives 75 percent of its funding from the U.S. Department of Health and Human Services under a grant award totaling $1,032,556 for Federal fiscal year (FY) 2025. The remaining 25 percent, totaling $344,185 for FY 2025, is funded by the State of New Hampshire.
