Attorney General Ken Paxton has joined an amicus brief in the U.S. Court of Appeals for the Seventh Circuit, aiming to prevent a District Judge from requiring taxpayers to fund gender transition surgeries for inmates in state prisons.
“Taxpayers should not be forced to fund dangerous and experimental procedures for prisoners based on radical gender theory. On his first day in office, President Trump signed an Executive Order to end this kind of nonsense,” stated Attorney General Paxton. “The United States recognizes two unchangeable sexes, male and female. That biological reality has always been true despite the political activism of extremist gender theory advocates.”
The brief, supported by Texas and 23 other states, backs Indiana's appeal against a case filed by an inmate demanding "gender affirming surgery." Paxton argued that the district court overstepped its authority by issuing a preliminary injunction requiring Indiana to provide the procedure.
Paxton has been vocal nationally against radical gender theory. He has taken legal action against doctors prescribing "gender transition" drugs to minors in Texas and sued the NCAA over policies he claims jeopardize women's sports by allowing biological men to compete.
