Brian Gill, a 59-year-old resident of Andes, New York, faces indictment for Social Security fraud. The charge involves his alleged concealment of employment at his tree service company while receiving disability benefits from the Social Security Administration.
The announcement was made by United States Attorney Carla B. Freedman and Amy Connelly, Special Agent in Charge of the Social Security Administration, Office of the Inspector General, New York Field Office.
If convicted, Gill could face up to five years in federal prison and a fine reaching $250,000. Additionally, he might be subject to three years of supervised release and could be required to pay restitution to the Social Security Administration for any funds fraudulently obtained. Sentencing would be determined by a judge based on relevant statutes and U.S. Sentencing Guidelines.
The charges remain accusations at this stage, with Gill presumed innocent until proven guilty. The case is under investigation by the Social Security Administration's Office of the Inspector General and is being prosecuted by Special Assistant United States Attorney Paul Tuck.
