An Española man, Isiah James Gutierrez-Arquero, has been charged with multiple felony counts related to domestic assault. The charges include strangulation and causing serious bodily injury. According to court records, Gutierrez-Arquero, 29, is an enrolled member of the Santa Clara Pueblo.
He faces three counts of assaulting Jane Doe on September 21, 2023. The specific charges are assault resulting in serious bodily injury, assault resulting in substantial bodily injury to a dating partner, and assaulting a dating partner by strangulation.
Gutierrez-Arquero will remain in custody until his trial date is set. If convicted, he could face up to 10 years in prison.
The announcement was made by U.S. Attorney Alexander M.M. Uballez. The Bureau of Indian Affairs conducted the investigation into this case, and Assistant U.S. Attorney Zachary Jones is handling the prosecution.
It is important to note that an indictment is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
