Buchanan Adds FDA Counsel in Charlotte

Buchanan Ingersoll & Rooney continues its strategic expansion in life sciences with the addition of Daniel McGee in its Charlotte, North Carolina office. He joins as Counsel in the firm’s FDA & Biotechnology section.

McGee advises manufacturers, distributors, and suppliers of tobacco products, including cigars, e-vapor, hookah, and nicotine, as well as cannabis, and hemp derived cannabinoid products, on regulations by federal agencies such as the U.S. Food and Drug Administration (FDA), as well as on matters of state law compliance. He previously served as in-house counsel for several tobacco, e-vapor, and CBD/hemp companies, where he gained valuable insight on the issues facing these industries.

He has been immersed in the tobacco and cannabis industry for his entire career, helping clients navigate a legal landscape that has been rapidly evolving,” said William Garvin, shareholder and co-chair of the section. “He adds significant depth to our FDA and cannabis practices and enhances value for our clients.”

McGee leverages his experience by supporting clients on labeling and warning statement requirements for covered tobacco products and their packaging. He also advises clients on tobacco and vape excise taxes, the Prevent All Cigarette Trafficking (PACT) Act and state law compliance, including licensing. His expertise in local, state and federal regulatory frameworks, as well as being fluent in Spanish, allow him to provide external general counsel advice on a wide range of topics, such as licensure, product registration, business formation and transactions, contracts, mergers and acquisitions, real estate, intellectual property, litigation and crisis management.

He has been active in recent litigation involving both vape and hemp clients across the country. In conjunction with local counsel, McGee successfully defended the nation’s first products liability case for a hemp derived cannabis product in the Circuit Court for Fayette County, Kentucky on behalf of a North Carolina based hemp product manufacturer against products liability, failure to warn, and negligence claims.
