Attorney General Gentner Drummond, along with attorneys general from 22 other states, has filed a petition for review in the United States Court of Appeals for the District of Columbia Circuit. The group is suing the U.S. Environmental Protection Agency (EPA) over its final rule that imposes a tax on methane.
"This unlawful and egregious tax is a last-ditch effort by the Biden Administration to once again attack our oil and gas industry," Drummond stated. "We must put an end to these antics once and for all."
The EPA's plan, proposed last year as part of the Inflation Reduction Act, introduces a new methane tax. This measure would require energy producers to pay penalties if their oil and gas facilities emit certain levels of methane.
Drummond contends in this week's petition that the rule goes beyond the EPA’s statutory authority and constitutes an unlawful abuse of discretion.
States joining Oklahoma in this legal action include Alabama, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Mississippi, Missouri, Montana, Nebraska, North Dakota, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, Virginia and Wyoming.
