Oregon DOJ issues guidance on AI compliance for local businesses

The Oregon Department of Justice has released new guidance for businesses in the state on the use of artificial intelligence (AI). Attorney General Rosenblum emphasized that AI, while a relatively new technology, must still comply with existing laws. These include the Unlawful Trade Practices Act, Consumer Privacy Act, and Equality Act.

"Artificial Intelligence is already changing the world, from entertainment to government to business," said Rosenblum. "But though machine-learning and AI platforms are relatively new, that doesn’t mean that these new tools operate outside existing laws!"

The guidance aims to help companies understand how these laws affect their implementation of AI. It addresses both businesses incorporating off-the-shelf AI platforms and those developing their own large-language models (LLMs).

"In short, Oregon businesses...still must comply with Oregon’s network of laws governing how companies use and protect consumer data and privacy," Rosenblum stated.

Rosenblum noted that regulation of AI is ongoing and the guidance may need updates based on future legislation at both state and federal levels. "This is just a starting point for those either beginning to think about — or even well down the road of – incorporating AI into their Oregon business plans and activities."
