Attorney General Todd Rokita is co-leading a multistate coalition to defend a Georgia law that restricts most abortions after the detection of a fetal heartbeat. The law faces challenges from pro-abortion advocates who argue that the Georgia constitution guarantees a right to abortion on demand.
Rokita emphasized the importance of defending pro-life laws in other states to prevent legal precedents that could threaten similar laws in Indiana. "By helping preserve pro-life laws in other states, we can prevent precedents that might endanger pro-life laws here in Indiana," he stated. He further expressed confidence in the legal standing of the Georgia law, describing it as "rock-solid" and likely to withstand challenges.
The argument against equating general privacy protections with abortion rights was highlighted by an amicus brief co-led by Attorney General Rokita and Florida Attorney General Ashley Moody. The brief references the U.S. Supreme Court's 2022 Dobbs decision, which overturned Roe v. Wade, rejecting such reasoning.
The brief argues against attempts to use Georgia's privacy rights to reinstate Roe-like protections within the state: “Yet Appellees invoke Georgia’s general right of privacy in an attempt to revive Roe in Georgia,” it asserts.
In addition to his efforts concerning the Georgia law, Attorney General Rokita continues his defense of a comprehensive pro-life law enacted by Indiana's legislature in 2022. He affirmed his commitment to upholding these measures despite political pressures: “While others may waver under political pressure, I will always stand strong for the right to life just as I defend so many other Indiana laws,” said Rokita.
