California Attorney General Rob Bonta has released a report on the officer-involved shooting of Austin Flores, which took place in Fresno, California, on May 19, 2022. The report is part of the California Department of Justice's efforts to ensure transparency and accountability in law enforcement practices.
Attorney General Bonta stated, "The tragic loss of life in this incident profoundly affects the entire state of California." He acknowledged the challenges faced by Mr. Flores’s family, law enforcement agencies involved, and the community. Bonta emphasized the DOJ's commitment to maintaining a fair and transparent legal system.
The incident occurred when officers attempted to serve a restraining order at a relative's residence. Officers encountered Mr. Flores, who brandished what appeared to be a firearm at an officer. In response, an officer fired nine rounds, resulting in Mr. Flores's death. The firearm was later found to be a replica.
Under Assembly Bill 1506 (AB 1506), which mandates investigations into all officer-involved shootings resulting in unarmed civilian deaths, the DOJ conducted an investigation. The report concluded that there was insufficient evidence for criminal charges against the officers involved. It was determined that the officers acted with intent to defend themselves from perceived imminent harm.
The DOJ's findings indicate no further action will be taken regarding this case.
