California Attorney General Rob Bonta has released a law enforcement bulletin detailing the changes brought by Proposition 36, also known as "The Homelessness, Drug Addiction, and Theft Reduction Act." This proposition was approved by California voters on November 5, 2024, and will be effective from December 18, 2024.

Attorney General Bonta emphasized the importance of collaboration in addressing organized retail crime. He stated, “Ultimately, our success in combating organized retail crime hinges on our ability to work together, innovate, and remain steadfast in our commitment to protecting our neighborhoods and businesses.” He further encouraged leveraging partnerships and new legislation to ensure community safety.

Proposition 36 introduces modifications to existing laws and adds new charges related to theft, property damage, and drug-related offenses. Key changes include the introduction of new felony theft and drug crimes aimed at repeat offenders. It also eliminates eligibility for certain sentences to be served in county jail under Penal Code section 1170(h), requiring state prison instead. Additionally, it aligns the punishment for fentanyl-related crimes with those for other controlled substances.
