Attorney General Mayes Files Motion With Arizona Supreme Court To Set Briefing Schedule In Death Penalty Case

Attorney General Kris Mayes filed a motion with the Arizona Supreme Court to establish a briefing schedule for a forthcoming motion requesting a warrant of execution for Aaron Brian Gunches. Gunches was sentenced to death for the 2002 murder of Ted Price.“This is not a decision that I have made lightly, but the death penalty is the law in our state, and it is my job to uphold it,” said Attorney General Mayes. “The family of Ted Price has waited for over 22 years for justice in this case, and I am committed to ensuring that justice is served.”

The filing gives notice of the State of Arizona’s intent to move for a warrant of execution under A.R.S. § 13–759(A) and Arizona Rule of Criminal Procedure 31.23(b). A copy of the State’s proposed motion for the Warrant of Execution is attached to the filing.
