California Attorney General issues updated guidance on immigrant rights protection

In response to threats of mass arrests, detentions, and deportations by the incoming Trump administration, California Attorney General Rob Bonta has issued updated policy models and recommendations for public institutions. The guidance aims to assist these institutions in complying with California laws that limit state and local participation in immigration enforcement activities. Originally released in 2018, this guidance is intended to help staff develop practical plans to protect the rights of immigrants and their families.

Attorney General Bonta emphasized California's commitment to immigrant rights regardless of federal leadership. "No matter who is in the White House, in California, we will continue leading with California values," said Bonta. "California is the most diverse state in the nation, and immigrants are a pillar of our economy, history, and culture."

The guidance covers courthouses, healthcare centers, colleges and universities, K-12 schools, labor agencies, public libraries, and shelters. State courts, public health centers, and public schools are required to implement these policies or equivalent ones. Other institutions are encouraged to adopt similar measures.

Each model policy outlines relevant federal and state protections for individuals seeking access to public institutions. It provides policy recommendations compliant with federal and state laws that can mitigate immigration enforcement disruptions within institutions.

Institutions are advised on several key points: prohibiting unauthorized collection or disclosure of information indicating nationality or immigration status; notifying individuals about privacy rights; directing law enforcement inquiries to designated personnel; identifying restricted areas within institutions; documenting requests related to immigration authorities; and training staff on handling such requests.

Californians should be aware of Senate Bill 54 (Statute of 2017), known as the "California Values Act," which restricts state and local law enforcement from assisting immigration forces with certain exceptions.
