New York Attorney General Letitia James has made public police body-worn camera footage related to the death of Mark Kelly. The footage is part of an ongoing investigation by her office into the incident that occurred on August 25, 2024, involving members of the New York City Police Department (NYPD) in Manhattan.
On the night of August 25, at approximately 12:33 a.m., NYPD officers encountered Mr. Kelly outside 1875 Third Avenue in East Harlem. He was reportedly holding a gun. During the interaction, officers discharged their weapons, hitting Mr. Kelly. He was subsequently taken to a local hospital where he was pronounced dead. A loaded gun was recovered at the scene.
The Office of Special Investigation (OSI) within the Attorney General’s Office released the footage from the body-worn cameras used by officers during this incident. This release aligns with Attorney General James’ directive for transparency and aims to build public trust in such matters.
According to New York State Executive Law Section 70-b, OSI reviews every reported incident where a police or peace officer might have caused a person's death through action or omission. This includes situations whether the officer is on-duty or off-duty and regardless of whether the deceased was armed or unarmed, in custody, or incarcerated. If OSI finds potential officer involvement in causing death, it conducts a full investigation.
Attorney General James emphasized that releasing this footage does not imply any judgment regarding guilt or innocence in any criminal matter nor does it suggest if anyone should be charged with a crime.
A warning accompanies the video due to its potentially disturbing content.
