New York Attorney General Letitia James' Office of Special Investigation (OSI) has released a report concerning the death of Mamady Cisse, who died on September 9, 2023, following an encounter with New York City Police Department (NYPD) officers in Bronx County. The investigation included reviewing body-worn camera footage, interviewing involved officers and bystanders, and conducting a comprehensive legal analysis.

The incident occurred when NYPD officers responded to a report from a 7-11 convenience store employee about a person acting "suspicious and weird" at the store located at 3508 East Tremont Avenue in the Bronx. Officers arrived at approximately 2:34 p.m. and found Mr. Cisse smoking in a back aisle with his hand in his pocket. Despite being told he could not smoke inside and being repeatedly directed to remove his hand from his pocket, Mr. Cisse did not comply.

Mr. Cisse then approached one of the officers while pulling out a knife from his pocket and ran toward the officer, prompting the officer to fire their service weapon, striking Mr. Cisse. He was taken to a local hospital where he was pronounced dead. A knife was recovered at the scene.

According to New York's justification law, police officers may use deadly physical force if they reasonably believe it is necessary for defense against deadly physical force by another individual. OSI concluded that under these circumstances, given the evidence and applicable law, it would be impossible for a prosecutor to disprove beyond reasonable doubt that the officer's actions were justified. Consequently, no criminal charges will be pursued in this case.
