Attorney General Todd Rokita has initiated legal proceedings against the owner of Hubbard Gardens Apartments in Indianapolis. The lawsuit claims that the apartment complex failed to safeguard tenants from open sewer conditions and neglected essential maintenance.
An inspection conducted by Attorney General Rokita’s Homeowner Protection Unit on September 27 revealed open sewer conditions, which were subsequently reported to the Environmental Protection Agency’s National Response Center. Residents have stated that plumbing and sewage issues have persisted for months without a lasting solution from the property's management.
“Hardworking Hoosiers don’t deserve to live in these types of conditions and are being treated horribly by the owner of this complex,” Attorney General Rokita said. “Our office will continue standing up for tenants’ rights and working to hold this bad actor accountable.”
The lawsuit highlights that Hubbard Gardens Apartments has been involved in at least 89 litigation cases related to violations of local health and housing codes, as documented by the Marion County Public Health Department between January 1, 2023, and October 4, 2024. These violations cite severe plumbing problems, including flooding with raw sewage in tenant apartments and common areas. The lawsuit seeks a jury trial, prosecution costs, and other damages for multiple breaches of the Deceptive Consumer Sales Act.
