Minnesota Attorney General Keith Ellison has announced a settlement with Blue Cross and Blue Shield of Minnesota to improve access to mental health services. The agreement seeks to enhance the availability and transparency of these services for Minnesotans.

The settlement follows an investigation initiated by the Attorney General’s Office in June 2019 into Blue Cross’ adherence to Minnesota's mental health parity laws. These laws mandate equal treatment for mental and physical health services, prohibiting any discrimination against mental health care.

Preliminary findings suggested that Blue Cross may not have fully complied with these requirements, although the company disputes this claim, asserting compliance with all relevant statutes and regulations. This settlement resolves the investigation.

Under the terms of the settlement, Blue Cross will contribute $600,000 to Minnesota State University-Mankato's Center for Rural Behavioral Health. This contribution aims to increase access to behavioral health services in rural areas of Minnesota.

Attorney General Ellison stated, “Mental and behavioral healthcare is healthcare, period.” He emphasized the importance of providing necessary care for conditions like depression or substance use disorder just as one would expect treatment for a physical injury.

The agreement also includes a stayed civil penalty of $300,000. If found in violation by a court, Blue Cross will be required to pay this amount to the state. The settlement remains effective until December 31, 2028.
