Attorney General Anthony G. Brown announced his decision to not seek charges in the January 30, 2024 fatal police-involved shooting in New Carrollton, Maryland.
On January 30, 2024, at approximately 4:35 a.m., officers with the New Carrollton Police Department were on patrol in the 7500 block of Annapolis Road in New Carrollton, when they observed a disabled SUV parked in the roadway. During the officers’ investigation, they learned that the SUV had been reported stolen in a carjacking earlier that evening. Approximately 20 minutes later, as the officers stood in a nearby parking lot, they were approached by a man, later identified as Artell Cunningham. As he walked toward the officers, Mr. Cunningham displayed two handguns. The officers then drew and discharged their service weapons, striking Mr. Cunningham.
The officers rendered medical aid. Two handguns were recovered from near Mr. Cunningham. Mr. Cunningham was taken to a local hospital where he was pronounced dead. The Attorney General’s Independent Investigations Division (IID) began investigating the fatal shooting on January 30, 2024, and concluded its investigation on October 17, 2024. After completing its investigation and evaluating all the available evidence, the Office of the Attorney General has determined that none of the officers involved in the fatal shooting committed a crime under Maryland law. Accordingly, the Attorney General has declined to prosecute any of the officers in this case.
