America First Legal (AFL) has initiated an investigation into the U.S. Department of Justice's (DOJ) interactions with The 65 Project, a group known for targeting conservative lawyers. The AFL describes The 65 Project as a "dark money group with ties to Democratic Party heavyweights."

Following the 2020 election, Kristen Clarke, then-president and executive director of the Lawyers’ Committee for Civil Rights Under Law, criticized post-election lawsuits as “frivolous” and filled with "conspiracy-laden theory and baseless allegations." She also suggested that former President Trump's phone call to Georgia officials could be considered potentially criminal under both state and federal election laws.

Michael Teter, managing director of The 65 Project, stated to CNN that establishing deterrence requires public awareness of filed complaints. However, Fordham Law School professor Bruce Green expressed concerns about these tactics, describing them as "problematic" because they aim to embarrass lawyers. This approach might discourage legal professionals from participating in politically sensitive work even if they adhere to legal standards.

With Kristen Clarke now leading the Civil Rights Division at the DOJ, AFL alleges that the Biden-Harris administration is using similar intimidation tactics against political opponents and citizens. AFL's investigation seeks to uncover any communications between the DOJ and The 65 Project.
