America First Legal (AFL) has filed a brief in the Supreme Court of the United States concerning the case United States v. Skrmetti et al. The brief supports Tennessee's stance against medical procedures related to gender transition for minors, which AFL describes as "inhumane medical experiments."
In March 2023, Tennessee enacted a law aimed at prohibiting experimental sex-transition drugs and surgeries on minors, citing risks such as irreversible sterility and psychological harm. This law faced a temporary block from enforcement by a federal district court but was later allowed to proceed after the U.S. Court of Appeals for the Sixth Circuit vacated the injunction in September 2023.
The Biden-Harris Administration has sought a review from the Supreme Court, which has agreed to hear the case. In its submission, AFL contends that the district court's decision to grant an injunction was flawed. AFL argues that plaintiffs did not establish standing because they could not demonstrate that an injunction would lead medical providers to resume these procedures given existing civil-liability provisions.
Gene Hamilton, Executive Director of America First Legal, stated: "The State of Tennessee took bold and common sense action to protect children within Tennessee from the horrors associated with so-called ‘gender transitions.’ Yet, as with most common sense measures, left-wing activists sprung into action to try to stop Tennessee from protecting children." He emphasized AFL's support for Tennessee in this legal matter.
The outcome of this case may have significant implications for similar laws across other states.
