America First Legal sues all Arizona counties over voter roll maintenance

America First Legal (AFL) has filed an amended lawsuit against all 15 counties in Arizona for not removing foreign citizens from their voter rolls. The counties involved are Apache, Cochise, Coconino, Gila, Graham, Greenlee, La Paz, Maricopa, Mohave, Navajo, Pima, Pinal, Santa Cruz, Yavapai, and Yuma.

On July 16, AFL sent letters to election officials in these counties demanding they fulfill their legal obligations to prevent non-citizens from voting. The organization warned that failure to comply would result in legal action.

On August 5, 2024, AFL sued the Maricopa County Recorder on behalf of Strong Communities Foundation of Arizona (EZAZ.org) and Yvonne Cahill. The lawsuit was based on Arizona state laws requiring monthly maintenance of voter lists to remove foreign citizens. Maricopa County removed the case to federal court on the grounds that it involved federal laws. This move allowed AFL to include all 15 counties in the lawsuit under federal court rules.

Stephen Miller, President of America First Legal, stated: “We are taking emergency action to secure our elections. In addition to Maricopa, we are now suing 14 additional counties in Arizona for refusing to remove illegal aliens and non-citizens from their voter rolls. America First Legal will do everything in its power to fight mass illegal alien voting and foreign interference in our democracy.”

The lawsuit references two federal statutes—8 U.S.C. § 1373(c) and 8 U.S.C. § 1644—that allow state and local officials to obtain information about individuals' citizenship or immigration status for any lawful purpose.
