Missouri Attorney General Andrew Bailey announced that the Eastern District of Missouri has granted his motion to block President Joe Biden’s proposed changes to Title IX, which would allow biological males in female spaces.
“This is a huge win for women and girls across the country. The Court recognized that Joe Biden’s plan to allow biological males into female spaces was not only blatantly illegal but also a slap in the face to every woman in America,” said Attorney General Bailey. “As the father of a young daughter, I take this fight personally. My office will continue to fight for the preservation of women and girls, who have a right to thrive without fear of being erased by a radical transgender ideology.”
The Department of Education’s new regulatory requirements would have mandated educational programs receiving federal funding to accept what Bailey termed "a radical transgender ideology." Title IX prohibits discrimination based on sex in any educational program receiving federal money, including K-12 schools, colleges, and universities. The new rule aimed to accommodate biological males’ entry into female-only spaces and organizations. Schools failing to comply with these requirements risked losing federal funding.
In May, General Bailey and other states filed a lawsuit asserting that Biden’s rewrite of Title IX was unconstitutional and bypassed congressional authority. They argued that the new rule denied women and girls crucial rights protected under federal law.
The court sided with Missouri today, ruling that the Department of Education’s new regulatory requirements were unconstitutional and an unlawful interpretation of Title IX.
Attorneys general from Arkansas, Iowa, Nebraska, North Dakota, South Dakota joined Missouri in filing suit along with an Arkansas high school athlete.
