America First Legal (AFL) has initiated an investigation into the role of the Biden Administration’s Department of Health and Human Services (HHS) in the prosecution of Texas Children’s Hospital whistleblower Dr. Eithan Haim.
The HHS has promoted procedures for children who identify as the opposite sex. However, on February 22, 2022, the Texas Attorney General opined that certain “gender-affirming” treatments could be considered child abuse under chapter 261 of the Texas Family Code. Subsequently, on March 4, 2022, Texas Children’s Hospital announced it would cease such procedures to protect healthcare professionals and families from potential legal consequences.
Despite this announcement, leaked documents published by Christopher Rufo on May 16, 2023, suggested that the hospital continued these treatments. In January 2024, Dr. Haim identified himself as the whistleblower behind these revelations. He stated: “It’s my responsibility as a doctor...to expose this to the public.” He emphasized that all sensitive patient information had been redacted before disclosure.
Dr. Haim was indicted on June 17, 2024. The United States Attorney for the Southern District of Texas issued a press release alleging that Dr. Haim accessed personal information of pediatric patients without authorization and disclosed it with malicious intent towards Texas Children’s Hospital. He faces charges classified as "Health Care Fraud," carrying a potential sentence of up to ten years in federal prison and a $250,000 fine.
AFL asserts that this prosecution exemplifies what they describe as the Biden Administration's misuse of the criminal justice system to advance its social agenda. AFL Senior Advisor Ian Prior commented: “The Biden Administration’s weaponization of the federal government is not just limited to political opponents but has now been extended to ordinary Americans who blow the whistle... America First Legal will leave no stone unturned in its mission to end this dark and inhumane practice.”
