America First Legal highlights Supreme Court ruling's impact on Trump's New York case

America First Legal (AFL) has released an educational document detailing the implications of the Supreme Court’s recent opinion in Trump v. United States on the ongoing criminal prosecution of President Trump in New York. This document is part of AFL’s series aimed at highlighting perceived errors in District Attorney Alvin Bragg’s case against Trump.

In Trump v. United States, the Supreme Court outlined three types of Presidential immunity. According to President Trump’s legal team, this decision supports their argument that evidence related to Trump's official acts should not have been admissible at trial. They assert that "the Trump decision confirmed the defense position that [District Attorney of New York] should not have been permitted to offer evidence at trial of President Trump’s official acts … The verdicts in this case violate the presidential immunity doctrine and create grave risks of ‘an Executive Branch that cannibalizes itself.’”

Judge Merchan has agreed to allow both parties to present arguments regarding this point, resulting in a delay of President Trump’s sentencing from July 11, 2024, to September 18, 2024—“if such is still necessary.”

This development adds another layer to what AFL describes as a series of errors and grounds for reversal in the prosecution.
