Trucking association sues New York over fees imposed by congestion plan

NEW YORK (Legal Newsline) - Truckers will be penalized for crossing below 60th street in Manhattan in order to alleviate traffic congestion, a federal lawsuit says, while the vehicles that cause that gridlock won't.

The Trucking Association of New York (TANY) filed a lawsuit May 30 in federal court against the Metropolitan Transportation Authority (MTA), Triborough Bridge and Tunnel Authority (TBTA), and Letitia James, in her capacity as Attorney General for the State of New York. 

The suit challenges the constitutionality of the Central Business District Tolling Program, set to begin on June 30, 2024. TANY argues that the program unfairly targets commercial trucks with hefty tolls each time they enter Manhattan's Central Business District, while exempting other vehicle classes like taxis and for-hire vehicles. 

The association claims this imposes an undue financial burden on its members without offering any benefits in return. TANY seeks a declaratory judgment deeming the tolling program unconstitutional and a preliminary injunction to halt its implementation.
