WEST PALM BEACH, Fla. (Legal Newsline) - A legal malpractice lawsuit accuses attorneys who specialize in nursing home cases of ignoring one and missing the time period to file it.
In a May 17 court filing in Palm Beach County Circuit Court, Alfreida Jones-Dukes has lodged a legal malpractice lawsuit against the law firms Kogan & DiSalvo, P.A., Law Offices of Kenneth R. Segal, and Kenneth R. Segal individually.
The plaintiff, on behalf of herself and the estate of her late father J.W. Jones, alleges that the defendants failed to advance her nursing home malpractice case adequately. This alleged negligence resulted in missing the two-year statute of limitations for wrongful death claims.
J.W. Jones allegedly suffered abuse at Heartland Rehabilitation and subsequently died on March 5, 2021, at Palm Beach Gardens Medical Center. Despite being retained on April 22, 2021, the defendant law firms did not file a complaint or take significant action until they withdrew from the case on October 1, 2023, citing non-cooperation—a claim Dukes disputes.
Dukes is seeking damages exceeding $50,000 for pain, grief, loss of companionship, and other emotional distress caused by the alleged malpractice.
