Organs donated without consent, says outrage lawsuit

HELENA-WEST HELENA, Ark. (Legal Newsline) - An Arkansas woman says her son's organs were donated without consent and is suing under the tort of outrage.

Irma Huckleby filed a lawsuit May 14 in Phillips County Circuit Court against Phillips Hospital Company, operating as Helena Regional Medical Center, and several of its staff members. 

The suit accuses the defendants of negligence and outrageous conduct related to the mishandling of her deceased son Kelly Huckleby's body. 

According to the complaint, numerous organs were removed and donated without Ms. Huckleby's consent, causing her severe emotional distress. The plaintiff is seeking damages for outrage and negligence.

"The Defendants owed the Huckleby family a duty to use ordinary care for the safety and preservation of their loved one's body," the suit says.

Donald Knapp represents the plaintiff.
