Attorney General Brown Announces That No Charges Will Be Filed in December 2023 Fatal Police Pursuit in Montgomery County

Attorney General Anthony G. Brown announced his decision to not seek charges in the December 2023 fatal police pursuit in Montgomery County, Maryland. On December 13, 2023, at approximately 10:15 p.m., officers with the Montgomery County Police Department attempted a traffic stop on a white Nissan Maxima in the area of Georgia Avenue and Plyers Mill Road in Wheaton, Maryland. 

The Nissan fled the stop and briefly eluded officers. The officers located the Nissan in the area of Bucknell Drive and Cambridge Park Court in Wheaton and attempted a second traffic stop. The Nissan struck a marked Montgomery County Police car and fled the scene. Officers pursued the Nissan, which led them onto northbound Georgia Avenue for approximately 1.5 miles. During the pursuit, at the intersection of Georgia Avenue and Henderson Avenue, the driver of the Nissan struck a median, lost control, and entered the southbound lanes of Georgia Avenue where it collided with two vehicles. The driver of the Nissan, an adult man, was taken to an area hospital with non-lifethreatening injuries. The passenger in the Nissan, a juvenile male, was pronounced dead on the scene. The drivers and one passenger in the other two vehicles were taken to area hospitals with non-life-threatening injuries. None of the officers were injured. The Attorney General’s Independent Investigations Division (IID) began investigating the fatal pursuit on December 13, 2023, and concluded its investigation on May 20, 2024. After completing its investigation and evaluating all the available evidence, the Office of the Attorney General1 has determined that none of the officers involved in the fatal pursuit committed a crime under Maryland law. Accordingly, the Attorney General has declined to prosecute any of the officers in this case.
