John Deere sued after combine goes up in flames

HARRISBURG, Ark. (Legal Newsline) - An Arkansas man says his John Deere combine malfunctioned and caught fire, so he's suing the company.

Nolan Evans filed a lawsuit May 8 in Poinsett County against Deere & Company and Greenway Equipment, Inc. over a 2021 John Deere S790 combine that caught fire on October 24, 2022, resulting in a total loss.

Evans alleges that the fire was caused by a failure of the left side discharge beater bearing. The lawsuit includes claims for breach of express warranty, breach of implied warranty of merchantability, strict liability in tort, and negligence. Evans is seeking damages amounting to $546,820.97.

"At the time of the fire, the plaintiff was using the combine in a normal and customary manner," the lawsuit says.

The plaintiff is represented by Eric G. Hughes from Hughes & Hughes Law Firm based in Arkadelphia.
