Justice Department introduces framework to enhance national response to sexual assault and domestic violence

The Justice Department has unveiled a new resource aimed at bolstering the national response to sexual assault and domestic violence. The Framework for Prosecutors to Strengthen Our National Response to Sexual Assault and Domestic Violence Involving Adult Victims, crafted by prosecutors, outlines five principles that promise improved outcomes for victims, safer communities, and increased accountability for perpetrators.

Attorney General Merrick B. Garland emphasized the importance of handling such cases in a way that avoids retraumatizing victims. He stated, “When investigating and prosecuting the heinous crimes of sexual assault and domestic violence, prosecutors must pursue justice in a manner that does not retraumatize victims and survivors.” He further affirmed the Justice Department's commitment to enhancing collective response to these crimes.

The guide addresses potential misconceptions about how crimes involving sexual assault and domestic violence are committed and reported. It emphasizes reliance on the victim’s account for framing investigations, collaboration between prosecutors, investigators, and victim specialists, effective use of law and evidentiary rules, thoughtful consideration of what justice looks like, and maintaining a productive workforce through redefining success.

Deputy Attorney General Lisa Monaco underscored the significance of achieving justice for victims as one of the Department's top priorities. She urged prosecutors nationwide to utilize this framework when handling such critical cases.

The guide was developed with input from over 120 state, Tribal, military, federal prosecutors as well as advocates, academics, investigators from various jurisdictions. It is intended to aid prosecutors at all experience levels in dealing with cases involving sexual assault and domestic violence.

Acting Associate Attorney General Benjamin C. Mizer expressed gratitude towards those who contributed their expertise to the guide's development. He also reiterated the Justice Department's commitment to strengthening prosecution efforts while ensuring a trauma-informed approach towards victims.

Director Rosie Hidalgo of the Justice Department’s Office on Violence Against Women (OVW) affirmed their commitment to expanding access to justice for all survivors. She highlighted the role of a trauma-informed prosecution response in ending gender-based violence and improving community safety.

The OVW, alongside the guide, has launched a new webpage offering resources to assist prosecutors in implementing the guide's principles. The OVW, established in 1995, provides leadership in reducing violence through the implementation of the Violence Against Women Act and subsequent legislation.
